Will UPKO do a 'SAPP'?
NST | When Sabah Progressive Party (SAPP) president Datuk Yong Teck Lee announced the party’s decision to leave the Barisan Nasional (BN) coalition on Sept 17, it did not surprise many people as it was expected.
This was because three months earlier, SAPP had given some indication of its intentions.
But when United Pasokmomogun Kadazandusun Murut Organisation (Upko) yesterday threatened to review its position in Barisan Nasional, it came as a shock; as it was reminiscent of SAPP’s political move.
Upko is the second BN component party in Sabah to make a “strong statement” against BN after SAPP.
While SAPP unveiled Sabah-related issues as its political “weapon”, Upko appeared to be unhappy with the way the National Registration Department (NRD) handled the plight of 78-year-old Yong Lee Hua, a Sino-Kadazan, who was issued a red identiy card (IC) with the status of a permanent resident when she went to replace her blue IC that she lost in a supermarket in Penampang last year.... selanjutnya.

Star | Gerakan is considering the option of leaving Barisan Nasional and joining the Pakatan Rakyat opposition alliance.
Gerakan acting president Tan Sri Dr Koh Tsu Koon said this was among three options for the party - the other two being to either stay with the ruling coalition, or leave and become independent.
“We are not ruling out any possibility at this moment. We have to assess the situation, but we are not closing any doors.
“Neither are we saying we will definitely leave. It’s something we need to assess but we cannot do it based on sentiments alone,” he told reporters after launching the KL-Federal Territory (FT) state delegates conference here on Sunday.... selanjutnya.

The Day of Reckoning
ngapsayot | Today is Sept 23, the day of reckoning. Or the day that will pass by and nothing happens. As I write this, we see West Malaysia is in a state of haywire and amazingly all eyes are suddenly on us in the East now. The politicians here are now being looked upon as the KingMakers to decide the fate of the nation. As we muddled through 2008, the state of chaos has resulted a deeper economic hardship to us. While you politicians are fighting each other for political dominance, we the rakyat, are suffering. And yet, you guys still doesn’t sit down and asked of what we really want. Instead, you continue to create issues that are degenerating our nation into mayhem.
Let us tell you that we, the People of the East want this chaotic situation to end. When we became part of Malaysia in 1963, there was a consensus under the Cobbold Commission. It gave each and every one of us the opportunity to show our preference. Now, what we want is a consensus again to determine to whom our allegiance are. Politicians may said they have the support from the people, but do they? All, in all we are the ones suffering from this debacle.
As the day goes by, life is still not going for the better. Anwar’s claim on the Federal Government is on the brink of collapse with some of our MPs wants to jump ship has only worsened the situation. Both sides are saying the other side is the main cause for this mayhem but do they really listening to us? ... selanjutnya.

Tan sets poser over SAPP membership
Star | Datuk Raymond Tan Shu Kiah has set a poser over his membership in the Sabah Progressive Party (SAPP).
Asked if he had resigned from SAPP, Tan said: “You have to ask them (SAPP).
Did you ask them whether they are sending a letter to Barisan Nasional (BN) officially, to say SAPP is out of the BN?
“I learnt it from them, that’s how they do it. They declare they are out of BN, so I also declare I’m out of SAPP.”
He spoke to reporters before meeting Sabah Chief Minister Datuk Seri Musa Aman to discuss his position in the State Cabinet following SAPP’s announced withdrawal from the BN on Sept 17.
Asked if he still considered himself a member of the SAPP, Tan replied: “Consider myself? Myself is not important, I think it is more of how SAPP considers me.”... selanjutnya.

No-confidence vote not the only way
Sun2surf | ...THE premise that Parliament has to be called for a vote of no-confidence against the prime minister (PM) to be passed is too simplistic, said advocate and solicitor Tommy Thomas. He was responding to an interview published on Thursday in theSun with constitutional law expert Prof Dr Shad Saleem Faruqi who said that under the Constitution [Article 43(4)], it is Parliament, and not the Agong, which must dismiss the PM.
Article 43(4) of the Constitution reads: If the PM ceases to command the confidence of the majority of the members of the House of Representatives, then, unless at his request the Yang di-Pertuan Agong dissolves Parliament, the prime minister shall tender the resignation of the cabinet.
“However, for Shad’s interpretation to be correct, Article 43(4) ought to read like this: If the Prime Minister is defeated on a motion of confidence in the House of Representatives, then…” Thomas said.
If Shad’s interpretation is right, it was limited to only one occasion and one fact pattern – that the matter needs to be brought to the Dewan Rakyat, he said, adding that the broad scope of the Constitution allowed for other methods to be applied.
“I accept the method Shad mentioned as the traditional method and the first method of preference; where I am disagreeing is that it is not the only method,” he said in an interview last Friday.
He said Article 43(4) represented the Reid Commission report draft and maintained its original form and essentially codified the British Constitutional principle that awards the Agong the exact same powers as the British monarch has. He said nearly all Commonwealth countries had persons who were in similar positions to the British monarch and had the same powers. India, being a republic, has a president while Australia and New Zealand have governors-general to represent the Queen.
So what are the other methods instead of a no-confidence vote?
Thomas: To answer this we have to first look at the fact that in almost every Commonwealth nation, there is a supreme head, a constitutional monarch. In Malaysia, it is the Agong as stipulated in Article 32(1) of the Federal Constitution. This supreme head has to be above politics and serve the role of stabilising the nation, especially in a time of crisis like this.
Article 43(2)(a), which states that the Yang di-Pertuan Agong shall first appoint PM to preside over the cabinet a member of the House of Representative who in his judgment is likely to command the confidence of the majority of the members of that House, leaves the discretion of appointing the PM to the Agong.
The King has to take the advice of the PM 99.999% of the time according to Article 40(1); however the Agong may act in his discretion to appoint the PM and to withhold the consent to a request for the dissolution of Parliament according to Article 40(2). ... selanjutnya.
