Judge Chin tells why he’s retiring early
Star | ... In a media statement distributed after attending a farewell gathering with Kota Kinabalu High Court staff yesterday, he said he no longer enjoyed working as a judge since last year.
“Suffice for me to say that all too often I found myself in circumstances where I had to make a stand which may be regarded as in defiance to a directive or instruction from my superior, which was very stressful to me,” he said.
Justice Chin had said former prime minister Tun Dr Mahathir Mohamad had made thinly veiled threats against judges at the Judges Conference in 1997. He said Dr Mahathir threatened to sack judges who did not support him. Dr Mahathir has denied the claims in his blog.
Justice Chin, 60, tendered his resignation on July 16 and will leave office on Dec 1.... more.

Karpal wants CJ to quit for lying about graft
Lepas ni kalau sapa sapa kena hukum kerana rasuah .. boleh rujuk sejarah Zaki ....malaysiainsider | DAP chairman Karpal Singh wants new Chief Justice Tan Sri Zaki Azmi to step down within a week for lying about graft, failing which the Bukit Gelugor MP intends tol reveal an audio recording of Zaki admitting to bribing court officials.
Karpal, who heads the parliamentary caucus on the integrity and independence of the judiciary, said he would file a motion against Zaki for having misled the country with his “so-called clarification” unless the Chief Justice resigns.
“We cannot have a Chief Justice who lies, simple as that,” Karpal Singh told reporters here today, adding: “We must start with integrity. There is no point having independence without integrity.”... selanjutnya.

Pendakwa tidak rayu pembebasan Razak
malaysiakini | Beliau mengesahkan perkara itu ketika dihubungi Malaysiakini petang ini.Belum jadi PM, dah nampaknya kuasanya
Bagaimanapun beliau tidak mahu mengulas lebih lanjut kerana kes tersebut masih berjalan.
Pada 31 Ogos lalu, Mahkamah Tinggi Shah Alam membebaskan Abdul Razak Baginda daripada tuduhan bersubahat membunuh wanita Mongolia tersebut.
Dua anggota polis daripada Unit Tindakan Khas, Cif Inspektor Azilah Hadri, 32, dan Koperal Sirul Azhar Umar, 36, yang dituduh membunuh Altantuya, diperintah membela diri.... selanjutnya.
Pendakwa pun dah tak mahu buat rayuan ...

Tiga pelajar kolej termasuk anak bekas menteri dibebaskan oleh Mahkamah Tinggi di sini daripada tuduhan membunuh Dr. T. Ariaratnam di kliniknya di Bangsar di sini, lima tahun lalu.
Lee Jun Ho, 27, Choy Chin dan Nor Azlan Idris yang masing-masing 25 tahun dibebaskan tanpa dipanggil bela diri oleh hakim Datuk Mohamed Apandi Ali di akhir kes pendakwaan.– Utusan.

Murder Most Foul
asiasentinel | ....As Asia Sentinel has repeated frequently, according to testimony in the trial of Altantuya's accused murderer Abdul Razak Baginda, her then-lover and one of the three men accused of killing her, the murdered woman accompanied him to Paris at a time when Malaysia's defense ministry, headed by Najib, was negotiating through a Malaysian company, Perimekar Sdn Bhd, to buy two Scorpene submarines and a used Agosta submarine produced by the French government under a French-Spanish joint venture, Armaris. Perimekar at the time was owned by a company called Ombak Laut, which was wholly owned by Abdul Razak.
The contract was not competitive. The Malaysian ministry of defense paid €1 billion (RM4.5 billion) to Amaris for the three submarines, for which Perimekar received a commission of €114 million (RM510 million). Deputy Defense Minister Zainal Abdidin Zin told the Dewan Rakyat, Malaysia's parliament, that the money was paid for "coordination and support services" although the fee amounted to a whopping 11 percent of the sales price for the submarines.
Altantuya, by her own admission in the last letter she wrote before her murder, had been blackmailing Razak, pressuring him for US$500,000. She did not say how she was blackmailing him, leaving open lots of questions.
Myriad questions have been raised by the year-long trial of Razak and two of Najib's bodyguards for Altantuya's murder. At every turn, those questions could have been answered by calling Najib to the stand. How could Razak, a civilian and Najib's closest friend, get the two bodyguards to kill Altantuya without Najib's knowledge? Najib could answer. How could the record of the victim being in the country disappear completely from Immigration Department records, as was sworn in court? Najib could answer. How could the murderers get their hands on the plastic explosives available only to the military used to blow up her body? Najib could answer. Why did neither the prosecution nor the defense push to investigate a statement made by Altantuya's cousin on the stand that she had seen a picture of Najib, Razak and Altantuya together at a dinner? Najib could answer.
The statutory declaration of P Balasubramaniam, the private detective hired by Razak to keep Altantuya away from him after their relationship had ended, is so closely detailed that it beggars disbelief that it was fabricated. It makes Najib an integral part of the case, something most of Malaysia's top government and judicial officials have been seeking to avoid ever since the trial began.
Balsasubramaniam released his sworn statement in the company of his lawyer, which makes it difficult to believe he was coerced. But immediately afterward he was summoned to a meeting with an assistant superintendant of police in Jalan Brickfields, where he was convinced - outside the presence of his lawyer that his memory was faulty. He then signed a statement that his original one had been compelled, and left the country.... selanjutnya.

Shah Alam Court is PROTECTING NAJIB...
vincentmklee | Najib and his wife are both suspects and witness. How can the court dismissed the application for them not to testify as witness? Is this a COVER UP by Najib and the COURT? We always see double standards, when any BN members is a suspect nothing is done to them but when it comes to the Pakatan Rakyat the police, special force, federal reserved and almost everyone jump on them.
THIS IS SO CLEAR! EVEN THE BLIND CAN SEE!
It's the same as the debate with Anwar, Najib and Abdulah DARE NOT COME FACE TO FACE because they can't answer to the public. They have to hide behind camera, they have to set people up. Watch prison break and you see how a government can be corrupted, Malaysia Government is no difference.
Asked any citizens and you will get the same reply, that they have lost confidence with BN especially UMNO.
Leaders or no leaders, they have to be treated the same as normal Malaysians. Najib is not just a witness, HE IS A SUSPECT! Najib should be arrested and detained as well until the case is solved. He should be strip from his position because of this case, he has brought disgrace to Malaysia.... selanjutnya.

Mahkamah tolak notis usul Karpal panggil semula Bala
Bharian | Mahkamah Tinggi di sini, hari ini menolak notis usul peguam pemerhati kepada keluarga Altantuya Shaariibuu, Karpal Singh, untuk memanggil semula penyiasat persendirian P Balasubramaniam bagi memberi keterangan di mahkamah pada perbicaraan kes bunuh wanita Mongolia itu.
Selain Balasubramaniam, notis usul itu turut meminta mahkamah memanggil Timbalan Perdana Menteri, Datuk Seri Najib Razak; Pegawai Pengiring, Deputi Superintendan Musa Safri; Ketua Siasatan Jenayah Balai Polis Brickfields, Deputi Superintendan Idris dan peguam, Dhiren Rene Norendra, supaya hadir sebagai saksi.

Court throws out Karpal's application to call Najib as witness in murder trial
Malaysiainisider | Lawyer Karpal Singh's application to call Deputy Prime Minister Datuk Seri Najib as witness and recall private investigator P. Balasubramaniam to the stand in the on-going Altantuya Sharibuu murder trial was thrown out this morning.
Speaking to the press outside of the court immediately after, he said he was surprised that DPP Tun Majid did not support it as the prosecution should have made the application in the first place but 'instead I had to do it'.
He reiterated that the police had said on July 19 that they would investigate everyone named in the two statutory declarations made by P. Balasubramaniam. 'How can the court make a finding on the credibility of Bala if investigations are still being carried out?'
Earlier in the court, judge Datuk Mohd Zaki Yasin had said, 'This court will only exercise that right when the need arises.' Karpal added later, 'I hope it does. The court should not just sit mutely.'
Karpal added that he might take this to the Court of Appeal.

Perintah Mahkamah Fitnah dan Salahguna Undang-undang

Saya menegaskan bahawa Pakatan Rakyat tidak pernah mengambil keputusan untuk mengadakan satu perhimpunan di Parlimen pada Isnin 14 Julai 2008.
Keputusan Ahli-Ahli Parlimen Pakatan Rakyat jelas iaitu untuk mengemukakan usul tidak percaya kepada kerajaan di bawah peruntukan 18(1) Peraturan Mesyuarat Parlimen.
Saya kesal kerana pihak polis sengaja mengaitkan nama saya dan Pakatan Rakyat dalam satu perintah mahkamah majistret yang diperolehi secara exparte oleh Ketua Polis Daerah Sentul bertarikh 13 Julai 2008. Majistret yang dikatakan membenarkan perintah tersebut adalah Tuan Nazran bin Mohd Sham. Perintah tersebut tidak diserah ke atas saya tetapi hanya ditampal di luar rumah pada hari ini.
Saya menganggap perintah mahkamah tersebut merupakan satu fitnah dan penyalahgunaan proses undang-undang. Saya akan mengarahkan peguam kami untuk memulakan proses undang-undang untuk mengenepikan perintah tersebut.

Gantung tugas Najib
siasah | PAS mencadangkan Datuk Seri Najib bercuti atau jawatannya digantung buat sementara untuk membolehkan siasatan bebas dibuat ke atasnya dan juga laporan polis terhadap Datuk Seri Anwar Ibrahim.
Ini berikutan kenyataan Anwar yang mendedahkan penyataan bersumpah Balasubramanian Perumal (gambar), penyiasat persendirian Abdul Razak Baginda yang mendedahkan Najib yang memperkenalkan Altantuya kepada Razak Baginda.
Di samping itu Najib juga didakwa oleh Bala, Razak Baginda memberitahunya, Najib ada hubungan sulit dengan wanita Monggolia itu.... selanjutnya.

Kenapa Pak Lah nak tutup kes?
Hah .... ni lagi perkara pelik. Dalam suasana tegang Pak Lah vs Mahathir, tiba tiba Pak lah angkat tangan tak mahu cerita panjang .... Kita baca dulu !!!
Baru baru ni Pak Lah melawat Sarawak dan isu yang berkaitan dengan Hakim di dalam artikel Malaysiakini [diatas] bersangkutan dengan keputusan pilihanraya di Sarawak. Apa yang Taib Mahmud dah cerita pada Dollah? Aku dah mula ragu ragu dengan tindakan menelus-muluskan sistem kehakiman ciptaan Pak lah. Mungkin nak kenakan Mahathir, bimbang terkena Taib Mahmud kot? Politik BN dah macam kerbau kat sawah, sekor kerbau bawa lumpur, habis semua kerbau terpalit sama. Termasuk gembala gembala sekali.Tiada s'jaya siasat Dr M-hakim
Ketika membuat pendedahan mengejutkan di mahkamah itu, Ian Chin juga mendedahkan bahawa beliau diancam oleh Dr Mahathir berhubung satu kes berprofil tinggi supaya membuat keputusan yang memihak kepada kenalan bekas perdana menteri itu.
"Tak payahlah. Tak habis-habis cerita itu," Abdullah dilaporkan berkata, mengulas kenyataan hakim itu.
Menurut satu lagi laporan agensi berita itu, menteri di Jabatan Perdana Menteri Datuk Zaid Ibrahim juga tidak berhasrat mengadakan siasatan atau suruhanjaya berhubung tuduhan terbaru dan mengejutkan itu.
"Saya tidak terkejut (dengan dakwaan terbaru ini) kerana sudah wujud cerita sebegitu di masa lepas.
"Persoalannya sekarang ialah bagaimana kita mahu menangani keadaan itu. Ia merupakan satu lagi maklumat yang mengecewakan dan kita perlu teruskan dari sini. - Malaysiakini

Kes Irene: Tangguh lagi?
Gua masih ingat lagi kata bos gua dulu .... dia kata "Undang undang manusia bikin." Lepas tu dia ketawa ... maknanya kalau undang undang manusia bikin, semua boleh gelembong. Dulu adalah kecoh sikit pasal kes mahkamah yang tertangguh-tangguh. Baca ini - Tumpu peguam terkenal antara punca kes tertangguh.Kes Irene tertangguh lagi...
malaysiakini - Bagaimanapun, kekurangan penjelasan mengenai bagaimana dokumen tersebut ditemui semula dan kesukaran membaca tulisan majistret yang mendengar kes tersebut sebelum ini, memaksa ia ditangguhkan sehingga 5 Ogos lalu.
Hari ini, peguamnya, M Puravalen meminta penjelasan Hakim Mahkamah Tinggi Kuala Lumpur, Datuk Mohamad Apandi Ali mengenai bagaimana dokumen yang hilang sebelum ini, ditemui semula, tetapi hakim itu tidak dapat menjawabnya.
Hakim kemudiannya membaca surat yang dierimanya dari mahkamah berkenaan yang hanya menyatakan bahawa dokumen-dokumen tersebut telah ditemui semula.
Bagaimanapun, Puravalen meminta hakim mengambil tindakan terhadap pihak-pihak yang bertanggungjawab dan untuk rekod, mendapatkan penjelasan mengenai bagaimana dokumen-dokumen tersebut ditemui semula.... selanjutnya.
Macam macam lah alasan yang ada. Peguam, hakim dan menteri pun bagi alasan masing masing ... tapi kelau di dalam kes ni... aku rasa ada yang tak kena.

Pendedahan hakim: Majlis Peguam terperanjat
malaysiakini - [...] Akhbar Borneo Post melaporkan dakwaan Chin bahawa Dr Mahathir telah mengugutkan untuk memecat para hakim jika mereka membuat penghakiman yang tidak menyebelahi pentadbirannya.
Chin mendengar petisyen pilihanraya yang difailkan oleh calon DAP, Wong Hua She, yang memohon mahkamah mengisytiharkan keputusan kerusi Parlimen dalam pilihanraya umum 8 Mac lalu sebagai batal dan tidak sah.
Calon Barisan Nasional (BN), Ding Kuong Hing menang kerusi tersebut dengan majoriti tipis 51 undi.
Ambiga menggesa Ketua Hakim Negara, Tun Abdul Hamid Mohamad dan pihak-pihak berkuasa yang lain supaya menjalankan siasatan yang terperinci berhubung dakwaan campurtangan pihak eksekutif itu
Katanya, terdapat khabar angin mengenai campurtangan seumpama itu, tetapi berkata ini adalah kali pertama seorang hakim yang masih berkhidmat mendedahkannya.... selanjutnya.

Judge: Many lawyers clueless
nst - [...] "Many of them are bad because of the low-quality training they received at local institutions of higher learning," Court of Appeal judge Datuk Gopal Sri Ram told the New Straits Times after the launch of a book, Malaysian Employment Laws, by M.N. D'Cruz here on Thursday.
Sri Ram, who has been in the legal profession for 40 years, said some lawyers did not have a clue how to introduce their opponents or to cite cases in court.
There was also a large number who did not know how to prepare written briefs, he added.

Mahkamah Keadilan Dunia
paulaland - This is the International Criminal Court (ICC). I made a mistake when ZB in the chat box ask me if I work for ICJ which is the International Court of Justice. And I replied no but said I passed through it everyday. I was mistaken. I passed through the ICC rather than ICJ. The International Court of Justice building is actually at the Peace Palace which is also in The Hague but a bit further to the North.
Anyway back to ICJ, a big decision was announced today. Pulau Batu Puteh which is just an outcrop of rocks in the water between Singapore and Malaysia you would reckon would only interest geologists. But apparently lawyers and politicians also love them. So a bunch of top class lawyers and politicians fought for these rocks for a number of years.... selanjutnya.

Missing/Lost/Destroyed Documents at the Courts
malaysiatoday - [...] The High Court of Malaya of which His Lordship The Chief Justice of Malaysia , is Head of is the Trustee & Custodian of all matters filed into the High Court. This simply means that The High Court must look after & maintain all Court Files containing papers filed in by us “ The Rakyaat “ who come to Court to seek redress.
The High Court of Malaya has lost my file, my documents {all of which I paid precious,hard earned monies for} and now you direct me to another body.
It is not the High Court of Malaya's bounden {legal,fiduiciary & moral} duty to itself contact all relevant parties & reconstruct the file, at its own cost?
Do you know what difficulties one faces with your courts , how many times back & forth one has to travel to retrieve one file OR do you{The High Court} really cares?
I have just completed "reconstructing" Three {3} Court Files that The High Court of Malaya lost {dihapuskan, dimakan olih inai inai,tidak bolih di kesan}. We have been attending at Jalan Duta, 15 times per matter{total 45 times}, because we are always asked to come on separate dates & times.We have spent a total of RM10,000/- on traveling,parking,photocopies, commissioner of oaths, binding, printing, dispatch, court fees “ on account of The High Court's sheer negligence & tidak apa attitude.
Puan XXX! Do you ever understand the sheer indignity of having to attend to your clerks, your Registrars, your Deputy Registrars, your Senior Assistant Regitrars,who are either never at their stations,busy, at meetings or who basically will not see us?...selanjutnya [KLIK DI SINI]

Hakim arah pegawai buat laporan polis terhadap kehilangan nota keterangan
Bharian - Hakim Datuk Mohamed Apandi Ali, yang mengetuai sidang rayuan mengeluarkan perintah itu selepas diberitahu oleh pegawai rekod mengenai kehilangan nota dan keratan akhbar berkenaan.
“Mahkamah memandang serius perkara ini kerana menyusahkan mahkamah untuk meneruskan prosiding rayuan hari ini,” katanya.
Beliau berkata pemeriksaan awal pegawai rekod mendapati nota dan barang kes itu kemungkinan hilang sebelum fail dipindahkan dari kompleks mahkamah lama di Jalan Raja ke lokasi sekarang pada pertengahan tahun lepas.
Hari ini ditetapkan untuk arahan rayuan selepas mahkamah diberitahu pada 1 April bahawa lebih 1,700 dokumen berhubung kes itu tidak dimasukkan ke dalam rekod rayuan.
Pada 16 Oktober 2003, Irene dijatuhi hukuman penjara selama setahun oleh Mahkamah Majistret selepas dia didapati bersalah menyiarkan berita palsu mengenai keadaan pekerja asing di kem tahanan. ...selanjutnya [KLIK DI SINI]

903,000 cases still pending

"I believe many of the cases registered in the lower courts here could be disposed of through mediation. It is no more business as usual but business in a hurry because we have to resolve the matter in hand."
However, he said parties to a dispute must agree to abide by the mediation exercise carried out by an independent party.
Zaid said this measure must be looked into seriously because of the alarming number of pending cases in the lower courts.

BAITULMAQDIS 28 Jan. _ Anak lelaki kepada bekas Perdana Menteri Israel, Ariel Sharon, akan mula menjalani hukuman penjara bulan depan setelah Mahkamah Agung hari ini menolak rayuannya.
Omri Sharon dijatuhkan hukuman penjara selama tujuh bulan oleh sebuah mahkamah di Tel Aviv pada Februari 2006 dan denda 300,000 shekel (RM262,507) selepas didapati bersalah melakukan penipuan dalam kempen bapanya merebut kepimpinan parti Likud pada tahun 1999.
Hukuman yang dijatuhkan ketika itu bagaimanapun ditangguhkan bagi memberi peluang kepadanya menghabiskan masa bersama mendiang yang ketika itu sedang koma akibat diserang strok pada Januari 2006. – AFP
